Age and Minor Use Policy

Effective Date: October 15, 2026 Version: 1.0 Applies to: All persons who hold or seek to hold an Account on the Platform, all parents and guardians whose household includes a minor who uses Products purchased through the Platform, and all Sellers.

Article 1: Introduction and Scope

1.1 This document governs the minimum age to hold an Account and to transact on the Platform, use of the Platform and of Products by minors under a parent's or guardian's Account, children's personal information, marketing in relation to minors, age verification, and the consequences of discovery of underage Account holding.

1.2 Registration and Account security in general are governed by the Account Registration and Security Policy. Treatment of personal information is governed by the Privacy Policy, which this document does not restate.

1.3 If a provision of this document conflicts with the Terms of Use, this document controls for the subject it governs. If a provision of this document conflicts with the terms of a program in which a party participates, the program terms control for that program. Policies and help pages explain this document; they do not amend it, and in any conflict this document prevails.

Article 2: Definitions

2.1 Account: the account a person or business establishes with the Company to use the Platform.

2.2 Account Holder: the person or business in whose name an Account is held and to whom the Account is attributed for all purposes under the Account Registration and Security Policy.

2.3 Buyer: a person who purchases Products or Services through the Platform.

2.4 Company: All About Pawz, LLC, a Tennessee limited liability company.

2.5 Minor: a person who has not reached the Age of Majority for that person's state of residence, as Article 3 states that age.

2.6 Order: a Buyer's purchase of Products or Services through the Platform, accepted in accordance with the Order Formation and Acceptance Policy.

2.7 Platform: the websites, applications, and services the Company operates under the name All About Pawz, including aapawz.com.

2.8 Products: goods offered for sale through the Platform.

2.9 Seller: a person or business the Company has accepted to offer Products or Services through the Platform.

2.10 Services: services offered through the Platform, including grooming, veterinary, pharmacy, and fulfillment services, as applicable.

2.11 Site: aapawz.com and its subdomains.

2.12 User: any person who accesses or uses the Platform, whether or not the person holds an Account.

Article 3: Minimum Age; Age of Majority by State of Residence

3.1 The rule. The age of majority is eighteen (18) years, except where the law of a person's state of residence sets a higher age of majority, in which case that higher age applies to that person. A person shall have reached the age of majority so determined: the Age of Majority for that person: in order to hold an Account or to transact on the Platform as the contracting party.

3.2 No exception to clause 3.1 arises from parental permission. Parental permission does not confer contractual capacity on a Minor and does not make a Minor an Account Holder. A Minor's use of the Platform occurs only under Article 5, through a parent's or guardian's Account held by an adult Account Holder.

3.3 A Seller shall have reached the Age of Majority for that Seller and shall have the legal right, authority, and capacity to sell, as governed by the Selling Terms of Service. A Seller Account operated by a Minor, including with an adult's knowledge, is a misrepresentation of the Account Holder and is governed by clause 7.3 and by the Account Registration and Security Policy.

3.4 Age is verified where the Platform has reason to verify capacity: Seller verification, a purchase of a Product whose regulation imposes an age condition, and any transaction in which capacity is in question, in each case as Article 6 provides. Casual browsing of the Site is not age-gated by this document.

Article 4: Children's Personal Information

4.1 The Company does not knowingly collect personal information from a person under eighteen (18) years of age as an Account Holder or as a subject of a Platform profile, as governed in full by the Privacy Policy. An Account found to belong to a Minor shall be closed and the Minor's personal information deleted, subject only to a retention duty imposed by law; such duties are narrow for an Account of that kind, which generates no tax records of the Minor.

4.2 A person who believes a Minor has provided personal information to the Company may report the belief to support@aapawz.com. The Company shall investigate the report and, where personal information of a Minor is found, shall delete that information in accordance with clause 4.1 and the Privacy Policy.

Article 5: Use by Minors Under a Parent or Guardian Account; Household Use

5.1 A Minor may use Products, and may access the Platform, only under the Account of a parent or guardian who is the Account Holder and who has reached the Age of Majority for that Account Holder. The Account Holder is the contracting party for every transaction on that Account and bears responsibility for all activity on that Account, in accordance with the Account Registration and Security Policy.

5.2 A Product intended for use by or around a Minor shall be purchased by the adult Account Holder. The Account Holder bears responsibility for safe use of the Product in the household in accordance with the Product's warnings and instructions. The Company sells to the Account Holder; supervision of the household is the Account Holder's responsibility.

5.3 Clause 5.2 applies with particular force to a Product that carries a risk identified in its warnings, including training equipment, grooming equipment, supplements, and a Product with small parts or chemical content. The Product's warnings are addressed to the purchaser, and the Account Holder shall read those warnings before a Product is given to or used around a Minor.

5.4 An Account Holder who gives a Minor access to a logged-in device or to the Account Holder's Credentials remains the Account Holder for every resulting transaction. An Account Holder shall not disclaim a transaction on the ground that a Minor placed the transaction using the Account Holder's Account or device.

Article 6: Seller Duties: Age Warnings on Listings

6.1 A Seller shall state on each listing every age warning the Product requires, including a choking-hazard warning, a chemical warning, and a use restriction, where the Product's character or its manufacturer's warnings call for such a warning.

6.2 A missing required age warning is a listing-safety violation. Absence of a warning in material supplied by a manufacturer is not a defence for the Seller of record on that listing; the Seller who offers the Product bears the duty in clause 6.1.

6.3 A Seller shall not market a listing to Minors as the purchasers of the Product. Listings are addressed to Account Holders, in accordance with Article 7 of this document's companion rule in clause 7.1 concerning marketing.

Article 7: Marketing in Relation to Minors

7.1 The Company does not direct marketing to children and does not knowingly build an advertising profile of a Minor. Promotional communications are sent to Account Holders, who are adults, in accordance with the Marketing Communications Policy and the Promotional Offers Terms.

7.2 User Content that includes an image of a Minor is governed by the User Content and Reviews Policy. A User shall not post an identifiable image of a Minor who is not that User's own child or ward.

Article 8: Age Verification: When and How

8.1 The Company verifies age where capacity matters: (a) at Seller onboarding, for every Seller, as part of the verification governed by the Account Registration and Security Policy; (b) at a purchase of a regulated Product, where the Product's regulation imposes an age condition; and (c) for any transaction in which the Company has reason to question the contracting party's capacity.

8.2 Verification under this Article uses government-issued identity checked against the Account Holder, by the same identity-verification means used for Seller verification. Self-attestation alone is not sufficient verification for a gated action under clause 8.1(b), where the consequence is regulatory; a statement of age at registration addresses the ordinary Account case and does not substitute for verification of a gated action.

8.3 Failed age verification blocks the gated action only. Failure to verify age for a Seller Account blocks Seller onboarding; failure does not, without more, bar the person from browsing the Site. The restriction follows the capacity requirement and extends no further.

8.4 A verification record under this Article is retained in accordance with the Privacy Policy and shall be used only to determine eligibility for the action verified.

Article 9: Discovery of Underage Account Holding

9.1 Where the Company discovers: through verification, a report, or an investigation: that an Account is held by a person who has not reached the Age of Majority for that person, the Company shall close the Account and shall delete the personal information in accordance with Article 4 and the Privacy Policy, subject only to a retention duty imposed by law.

9.2 An open Order on an Account closed under clause 9.1 is resolved by outcome: (a) an unshipped Order is cancelled, with a full refund to the original payment method; and (b) a shipped Order is handled through the ordinary return process under the Returns and Refunds Policy. Closure under this Article shall not leave an amount paid on such an Order unaccounted for.

9.3 Account held in an adult's name and operated by a Minor. An adult who creates an Account in the adult's name and permits a Minor to operate that Account has not transferred the Account. The Account is the adult's Account, the adult is the Account Holder, the adult bears responsibility for all activity on the Account, and the adult shall not disclaim a transaction on the ground that the Minor placed the transaction. Clauses 5.4 and 9.3 apply together; the Company may treat knowing creation of an Account for operation by a Minor as a misrepresentation of the Account's use under the Account Registration and Security Policy.

Article 10: Liability

10.1 Exclusion of certain damages. To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, punitive, or consequential damages, or for lost profits, lost revenue, or loss of goodwill, arising out of or relating to this document, even if the party has been advised of the possibility of those damages.

10.2 Cap. To the fullest extent permitted by law, the Company's total liability arising out of or relating to this document shall not exceed the greater of (a) the amounts the Account Holder paid to the Company under this document in the twelve months before the event giving rise to the claim, or, where the claim arises from an Order, the amounts paid for that Order, or (b) one hundred dollars ($100).

10.3 Carve-outs. This Article does not limit (a) a party's indemnification obligations under this document; (b) liability for fraud or willful misconduct; (c) amounts owed for Orders or refunds under a governing document; or (d) liability that cannot be limited under applicable law.

10.4 Essential purpose. The parties agree that this Article allocates risk between them, that it is an essential part of the basis of their bargain, and that it applies even if a limited remedy fails of its essential purpose.

Article 11: Indemnification

11.1 Duty. The Account Holder shall indemnify, defend, and hold harmless the Company and its members, managers, employees, and agents from and against every claim, demand, action, loss, liability, judgment, settlement, cost, and expense (including reasonable attorneys' fees) arising out of or relating to: (a) the Account Holder's breach of this document, including permitting operation of the Account by a Minor in the circumstances described in clause 9.3; (b) use of a Product purchased through the Platform in the Account Holder's household; (c) the Account Holder's violation of any law or of the rights of any person; and (d) taxes for which the Account Holder is responsible under a governing document. A Seller shall give the same indemnity for a listing that omits a required age warning in breach of Article 6.

11.2 Procedure. The Company shall give prompt written notice of a claim under this Article. The indemnifying party shall control the defense with counsel reasonably acceptable to the Company. The Company may participate in the defense at its own expense. The indemnifying party shall not settle a claim in a manner that imposes any obligation or restriction on the Company, or that does not release the Company fully, without the Company's prior written consent.

11.3 Survival. This Article survives the termination of this document.

Article 12: Enforcement and Appeals

12.1 Investigation. The Company may investigate any suspected violation of this document. The Account Holder and the Seller shall cooperate with an investigation and shall produce the records this document requires that party to keep.

12.2 Notice. If the Company determines that a party has violated this document, the Company shall give written notice stating the provision violated and the facts relied on, except where notice would compromise an investigation of fraud, a safety risk, or a legal obligation.

12.3 Opportunity to cure. Where a violation is capable of cure, the party has ten (10) business days from notice to cure it and to confirm the cure in writing. No cure period applies to fraud, counterfeiting, a risk to the safety of a person or an animal, unlawful conduct, or a violation that by its nature cannot be cured. No cure period applies to Account holding by a Minor, which is resolved by closure under Article 9.

12.4 Measures. If a violation is established and is not cured within the period allowed, the Company may, proportionate to the violation: (a) issue a written warning; (b) remove or suppress a listing that omits a required age warning, or other content; (c) cancel an Order; (d) suspend the Account, in whole or in part; (e) terminate this document and the Account; and (f) exercise any other right or remedy available under this document or at law.

12.5 Appeal. A party may appeal a measure under this Article by written notice to legal@aapawz.com within thirty (30) days of the measure, stating the grounds and attaching the records relied on. The appeal is decided by a person who did not make the original decision. The Company's decision on appeal is final. A measure remains in effect during an appeal unless the Company directs otherwise in writing. An appeal does not restore an Account closed under Article 9 unless the appeal establishes that the Account Holder had in fact reached the Age of Majority for that Account Holder.

12.6 No waiver by delay. The Company's delay in acting on a violation is not a waiver of the violation or of any later violation of the same kind.

Article 13: Term and Termination

13.1 Term. This document takes effect when a person registers for an Account or first uses the Platform and continues until terminated under this Article.

13.2 Termination by the Company. The Company may terminate this document and the Account on thirty (30) days' written notice for any reason, and immediately on written notice if a party materially breaches this document, engages in fraud, or is ineligible to hold an Account, including by reason of age under Article 3.

13.3 Termination by the Account Holder. The Account Holder may terminate this document on thirty (30) days' written notice to support@aapawz.com, provided the Account Holder has no Order, booking, or investigation outstanding.

13.4 Effect of termination. On termination: (a) the rights granted under this document end; (b) obligations that arose before termination: including payment, refund, record-keeping, and indemnification obligations, and the refund obligations in clause 9.2 for an Account closed by reason of age: survive until satisfied; and (c) the Company shall disburse amounts owed, less amounts the Company may set off under this document or another governing document, within thirty (30) days, except amounts held in connection with an open investigation or dispute.

13.5 Survival. The Definitions, Liability, Indemnification, Enforcement and Appeals (for measures taken before termination), Dispute Resolution, and General Provisions Articles survive termination.

Article 14: Dispute Resolution

14.1 Any dispute arising out of or relating to this document, or to the relationship it governs, is governed by the Dispute Resolution Policy, which is incorporated into this document by reference.

Article 15: General Provisions

15.1 Amendments. The Company may amend this document by posting the amended document in the Document Center and giving notice to Account Holders at the email address in the Account. An amendment that materially increases an Account Holder's obligations takes effect thirty (30) days after notice; other amendments take effect on posting. Continued use of the Platform after the effective date of an amendment is acceptance of it. If an Account Holder does not accept an amendment, the Account Holder's remedy is to terminate under Article 13 before the amendment takes effect.

15.2 Notices. (a) Legal notices under this document shall be sent to legal@aapawz.com. Operational notices and all other communications shall be sent to support@aapawz.com. A notice to the Company is effective when the Company acknowledges receipt or, for email, one business day after sending, whichever is earlier. (b) Notices to a party are effective when sent to the email address in the Account or posted to the Account's notice facility in the portal, whichever occurs first. Each Account Holder shall keep the email address in the Account current. (c) DMCA notices are given as provided in the DMCA and Copyright Policy, to the designated agent at legal@aapawz.com.

15.3 Governing law. This document is governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Subject to the Dispute Resolution Policy, any proceeding arising out of this document shall be brought in the state or federal courts located in Shelby County, Tennessee, and the parties consent to personal jurisdiction there. The age of majority applicable to a person under Article 3 is determined by the law of that person's state of residence, as clause 3.1 states.

15.4 Severability. If any provision of this document is held unenforceable, the provision shall be enforced to the fullest extent permitted, and the remaining provisions continue in full effect.

15.5 Entire agreement. This document, together with the documents it incorporates by reference, is the entire agreement between the Company and the Account Holder for the subject it governs and supersedes every prior or contemporaneous statement, communication, or agreement on that subject, whether written or oral.

15.6 Assignment. An Account Holder shall not assign this document or any right or obligation under it without the Company's prior written consent, and an assignment without consent is void. The Company may assign this document to an affiliate or in connection with a sale of all or part of its business, on notice to Account Holders.

15.7 Waiver. A waiver of any provision of this document is effective only in writing and only for the instance stated. No waiver is a waiver of any other provision or instance.

15.8 Interpretation. Headings are for convenience only. "Including" means "including without limitation." This document shall not be construed against a party as its drafter. The English-language text controls over any translation.
