Dangerous Goods Policy

Effective Date: October 15, 2026 Version: 1.0 Applies to: All Sellers who offer Products with hazardous characteristics through the Platform.

Article 1: Introduction and Scope

1.1 This Policy states the Seller's duties for Products with hazardous characteristics: classification before listing, disclosure in the listing, compliant packaging and documentation, and shipment only by a carrier and a service level that accept the classification. Such Products are a restricted category under the Restricted Products Policy, and the platform rule for restricted Products is stated in the Prohibited and Restricted Products Policy, which is incorporated into this Policy by reference.

1.2 The duty begins with the Seller, not the carrier. Classification comes first, and packaging, labeling, carrier, and service level follow from the classification. The controlling requirements are the hazardous materials regulations of the U.S. Department of Transportation (49 CFR Parts 171–180), the applicable requirements of the Occupational Safety and Health Administration, and each carrier's published hazardous materials rules. Where any of those requirements is more restrictive than this Policy, the more restrictive requirement controls.

1.3 If a provision of this Policy conflicts with the Terms of Use, this Policy controls for the subject it governs. If a provision of this Policy conflicts with the terms of a program in which the Seller participates, the program terms control for that program.

Article 2: Definitions

2.1 Account: the account a person or business establishes with the Company to use the Platform.

2.2 Buyer: a person who purchases Products or Services through the Platform.

2.3 Company: All About Pawz, LLC, a Tennessee limited liability company.

2.4 Dangerous Goods: Products that are hazardous materials under the regulations of the U.S. Department of Transportation: articles or substances capable of posing an unreasonable risk to health, safety, or property when transported. On the Platform such Products most often include aerosols, including flea sprays and grooming sprays; flammable liquids, including certain shampoos and solvents; corrosives, including cleaners; pressurized containers; Products containing a lithium battery, including tracking devices, electronic collars, and automatic feeders; and Products containing a toxic substance.

2.5 Forbidden Material: a material that the U.S. Department of Transportation or the carrier bars from the relevant transport mode entirely, including carriage on a passenger aircraft and carriage in a consumer parcel stream. A Forbidden Material is a Prohibited Product under the Prohibited Products Policy, not a Restricted Product.

2.6 Limited Quantity: an exception in the transportation regulations that permits reduced packaging, marking, and documentation for small amounts of certain hazard classes. The exception reduces the requirements; it does not remove the classification duty, and the limited-quantity marking shall appear on the package where the exception is claimed.

2.7 Misdeclaration: shipping a Dangerous Good as an ordinary parcel: a wrong or missing hazardous materials declaration, an undeclared lithium battery, and an aerosol shipped as a standard package are each a Misdeclaration.

2.8 Order: a Buyer's purchase of Products or Services through the Platform, accepted in accordance with the Order Formation and Acceptance Policy.

2.9 Platform: the websites, applications, and services the Company operates under the name All About Pawz, including aapawz.com.

2.10 Products: goods offered for sale through the Platform.

2.11 Safety Data Sheet: the hazard communication document for a hazardous Product, maintained by the Seller under Article 3.4.

2.12 Seller: a person or business the Company has accepted to offer Products or Services through the Platform.

Article 3: Classification and Listing Duties

3.1 Classification before listing. The Seller shall classify every Product with hazardous characteristics, in regulatory terms, before the first sale, and shall declare the classification in the listing data: the hazard class and division, the UN number where applicable, and the limited-quantity or excepted-quantity basis claimed. A Seller that has not classified a Product has not satisfied this Policy for that Product, and lack of knowledge of a Product's characteristics is not a defense to a classification failure.

3.2 Disclosure to the Buyer. The listing shall disclose the hazardous characteristic where the characteristic is material to the purchase: that the Product contains a lithium battery, that the Product is an aerosol, or that the Product ships under hazardous materials handling with the delivery consequences that follow. The disclosure shall appear before checkout.

3.3 Forbidden and mode-limited Products. A Forbidden Material shall not be listed. Where a Product is permitted only by specified modes or service levels, the listing and the fulfillment configuration shall constrain shipment to those modes and levels, so that a forbidden option cannot be selected for the Product.

3.4 Safety Data Sheets. The Seller shall maintain a Safety Data Sheet for each hazardous Product and shall produce the sheet within twenty-four (24) hours of a request by the Company, by the carrier, or by emergency responders. A sheet the Seller cannot produce within that period is a compliance failure independent of the underlying classification.

Article 4: Packaging, Labeling, and Shipping

4.1 Dangerous Goods shall be packaged, marked, labeled, and documented in accordance with the transportation regulations and the carrier's requirements for the classification, including authorized packaging, hazard labels, limited-quantity markings where the exception is claimed, and shipping papers where required. The Seller shall follow the carrier's published hazardous materials guide for the service level used.

4.2 Only a carrier and a service level that accept the classification shall be used. A ground-only classification shall not be shipped by air. A shipping label created for an ineligible service level is a Misdeclaration, whether or not the package is intercepted.

4.3 Quantity limits per package, segregation from incompatible materials, and orientation markings shall be observed as the classification requires.

4.4 Packaging under this Article is in addition to the Packaging Policy, and shipment under this Article is in addition to the Shipping Policy. An aerosol pesticide Product is subject to this Policy and to the Flea, Tick and Pesticide Products Policy at the same time.

Article 5: Lithium Batteries

5.1 Tracking devices, electronic training collars, automatic feeders, and illuminated leashes run on lithium batteries, and the lithium battery is the most frequently misdeclared Dangerous Good in electronic commerce. The Seller shall classify every Product containing a lithium battery before listing, under Article 3.1.

5.2 Cells and batteries shall satisfy the UN 38.3 testing requirements, and the watt-hour rating shall be declared in the listing data for every battery Product the Seller offers. The watt-hour rating determines the transport rules that apply.

5.3 A damaged, defective, or recalled battery is Forbidden Material. Such a battery shall not be shipped in any stream, including in a replacement shipment for a returned device; the battery is directed to proper disposal.

5.4 A spare or loose battery, not installed in equipment, is subject to stricter rules than a battery installed in equipment at every carrier. The listing shall distinguish the two, and fulfillment shall follow the stricter path for a spare.

Article 6: Aerosols and Flammable Liquids

6.1 An aerosol flea spray or grooming spray is typically a flammable aerosol (Class 2.1) or a non-flammable compressed gas (Class 2.2), as the Safety Data Sheet and the classification state. A flammable liquid in a grooming or cleaning Product carries the packing group its flash point determines. Marketing copy does not determine the class; the classification does.

6.2 Limited-quantity provisions cover many consumer aerosols and small flammable-liquid containers. The provisions count only where each condition is satisfied: inner packaging limits, the limited-quantity mark, and carrier acceptance.

Article 7: Records

7.1 The Seller shall keep the records this Policy requires: classification records, Safety Data Sheets, shipping papers, and carrier acceptance records: for the period the Selling Terms of Service requires, and shall produce the records on the Company's request, including in an investigation or an appeal under Article 10.

Article 8: Liability

8.1 Exclusion of certain damages. To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, punitive, or consequential damages, or for lost profits, lost revenue, or loss of goodwill, arising out of or relating to this Policy, even if the party has been advised of the possibility of those damages.

8.2 Cap. To the fullest extent permitted by law, the Company's total liability arising out of or relating to this Policy shall not exceed the greater of (a) the amounts the Seller paid to the Company under this Policy in the twelve months before the event giving rise to the claim, or (b) one hundred dollars ($100).

8.3 Carve-outs. This Article does not limit (a) a party's indemnification obligations under this Policy; (b) liability for fraud or willful misconduct; (c) amounts the Seller owes for Orders, fees, chargebacks, or refunds under this Policy; or (d) liability that cannot be limited under applicable law.

8.4 Essential purpose. The parties agree that this Article allocates risk between them, that it is an essential part of the basis of their bargain, and that it applies even if a limited remedy fails of its essential purpose.

Article 9: Indemnification

9.1 Duty. The Seller shall indemnify, defend, and hold harmless the Company and its members, managers, employees, and agents from and against every claim, demand, action, loss, liability, judgment, settlement, cost, and expense (including reasonable attorneys' fees) arising out of or relating to: (a) the Seller's breach of this Policy; (b) the Seller's Products, listings, shipments, or content, including product liability claims and claims arising from a Misdeclaration; (c) the Seller's violation of any law or of the rights of any person; and (d) taxes for which the Seller is responsible under the Company's documents.

9.2 Procedure. The Company shall give prompt written notice of a claim under this Article. The Seller shall control the defense with counsel reasonably acceptable to the Company. The Company may participate in the defense at its own expense. The Seller shall not settle a claim in a manner that imposes any obligation or restriction on the Company, or that does not release the Company fully, without the Company's prior written consent.

9.3 Survival. This Article survives the termination of this Policy.

Article 10: Enforcement and Appeals

10.1 Investigation. The Company may investigate any suspected violation of this Policy. The Seller shall cooperate with an investigation and shall produce the records this Policy requires the Seller to keep.

10.2 Notice. If the Company determines that the Seller has violated this Policy, the Company shall give written notice stating the provision violated and the facts relied on, except where notice would compromise an investigation of fraud, a safety risk, or a legal obligation.

10.3 Opportunity to cure. Where a violation is capable of cure, the Seller has ten (10) business days from notice to cure it and to confirm the cure in writing. No cure period applies to fraud, counterfeiting, a risk to the safety of a person or an animal, unlawful conduct, or a violation that by its nature cannot be cured. No cure period applies to a Misdeclaration already shipped.

10.4 Measures. If a violation is established and is not cured within the period allowed, the Company may, proportionate to the violation: (a) issue a written warning; (b) remove or suppress a listing or content, including suppression of a listing that lacks the classification declaration the listing requires, until the classification data is supplied; (c) cancel an Order; (d) suspend the Account, in whole or in part, and on a second Misdeclaration within three hundred sixty-five (365) days, audit the Seller's classifications for every Product with hazardous characteristics; (e) terminate this Policy and the Account; and (f) exercise any other right or remedy available under this Policy or at law. An undeclared or misclassified Dangerous Good shipped as an ordinary parcel is a serious violation, and the measure attaches to the shipment and not only to the listing. An intentional Misdeclaration that endangers transport workers is governed by the Fraud and Abuse: Zero Tolerance (Fraud and Abuse — Zero Tolerance), under which no warning precedes an account-level measure. A Forbidden Material listing is removed under the Prohibited Products Policy.

10.5 Appeal. The Seller may appeal a measure under this Article by written notice to legal@aapawz.com within thirty (30) days of the measure, stating the grounds and attaching the records relied on. The appeal is decided by a person who did not make the original decision. The Company's decision on appeal is final. A measure remains in effect during an appeal unless the Company directs otherwise in writing.

10.6 Disbursement holds. The Company may hold disbursements to the Seller while an investigation under this Article is pending, and shall release amounts not required to satisfy the Seller's obligations when the investigation closes.

10.7 No waiver by delay. The Company's delay in acting on a violation is not a waiver of the violation or of any later violation of the same kind.

Article 11: Term and Termination

11.1 Term. This Policy takes effect when the Seller is accepted to offer Products through the Platform and continues until terminated under this Article.

11.2 Termination by the Company. The Company may terminate this Policy and the Account on thirty (30) days' written notice for any reason, and immediately on written notice if the Seller materially breaches this Policy, engages in fraud, or becomes ineligible to participate.

11.3 Termination by the Seller. The Seller may terminate this Policy on thirty (30) days' written notice to support@aapawz.com, provided the Seller has no Order or investigation outstanding.

11.4 Effect of termination. On termination: (a) the rights granted under this Policy end; (b) obligations that arose before termination: including payment, refund, chargeback, record-keeping, and indemnification obligations: survive until satisfied; and (c) the Company shall disburse amounts owed, less amounts the Company may set off under this Policy, within thirty (30) days, except amounts held in connection with an open investigation or dispute.

11.5 Survival. The Definitions, Liability, Indemnification, Enforcement and Appeals (for measures taken before termination), Dispute Resolution, and General Provisions Articles survive termination.

Article 12: Dispute Resolution

12.1 Any dispute arising out of or relating to this Policy, or to the relationship it governs, is governed by the Dispute Resolution Policy, which is incorporated into this Policy by reference.

Article 13: General Provisions

13.1 Amendments. The Company may amend this Policy by posting the amended Policy in the Document Center and giving notice to the Seller at the email address in the Account. An amendment that materially increases the Seller's fees or obligations takes effect thirty (30) days after notice; other amendments take effect on posting. Continued use of the Platform after the effective date of an amendment is acceptance of it. If the Seller does not accept an amendment, the Seller's remedy is to terminate under Article 11 before the amendment takes effect.

13.2 Notices. Legal notices under this Policy shall be sent to legal@aapawz.com. Operational notices and all other communications shall be sent to support@aapawz.com. A notice to the Company is effective when the Company acknowledges receipt or, for email, one business day after sending, whichever is earlier. Notices to the Seller are effective when sent to the email address in the Account or posted to the Account's notice facility in the portal, whichever occurs first. The Seller shall keep the email address in the Account current.

13.3 Governing law. This Policy is governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Subject to the Dispute Resolution Policy, any proceeding arising out of this Policy shall be brought in the state or federal courts located in Shelby County, Tennessee, and the parties consent to personal jurisdiction there.

13.4 Severability. If any provision of this Policy is held unenforceable, the provision shall be enforced to the fullest extent permitted, and the remaining provisions continue in full effect.

13.5 Entire agreement. This Policy, together with the documents it incorporates by reference, is the entire agreement between the Company and the Seller for the subject it governs and supersedes every prior or contemporaneous statement, communication, or agreement on that subject, whether written or oral.

13.6 Assignment. The Seller shall not assign this Policy or any right or obligation under it without the Company's prior written consent, and an assignment without consent is void. The Company may assign this Policy to an affiliate or in connection with a sale of all or part of its business, on notice to the Seller.

13.7 Waiver. A waiver of any provision of this Policy is effective only in writing and only for the instance stated. No waiver is a waiver of any other provision or instance.

13.8 Interpretation. Headings are for convenience only. "Including" means "including without limitation." This Policy shall not be construed against a party as its drafter. The English-language text controls over any translation.
